2009/2010 Nissan Master the Shift Sweepstakes

1. Eligibility: The 2009/2010 Nissan Master the Shift Sweepstakes (”Sweepstakes”) is offered in and open only to legal residents of the United States and District of Columbia (”U.S.”) age 18 and older or of age of majority in state of residence, whichever is older, who have a valid driver’s license. Employees, officers, and directors of Rodale Inc.(”Sponsor”), Nissan North America, Inc., Alcone Marketing Group, Nissan dealers, and each of their respective parents, affiliates and subsidiaries, advertising, promotion and fulfillment agencies, entities involved in the design and implementation of the sweepstakes, and the immediate family members (spouse, parents, siblings and children and their spouses and in-laws) and persons living in the same household of such individuals are not eligible. Void where prohibited.
2. Sweepstakes Period: Sweepstakes is scheduled to begin on April 20, 2009 at 12:00:01 a.m. Eastern Time (ET) and ends on March 31, 2010 at 11:59:59 p.m. (ET). A week begins on Monday at 12:00:01 a.m. (ET) and ends the following Sunday at 11:59:59 p.m. (ET), except for the last week which begins on Monday, March 29, 2010 at 12:00:01 a.m. (ET) and ends on Wednesday, March 31, 2010 at 11:59:59 p.m. (ET). The Sweepstakes computer is the official time keeping device for the Sweepstakes.

3. To Participate: Access http://mastertheshift.com ("web site") and click on the icon, banner or link to be taken to the Sweepstakes registration page. On that page provide the required information, specifically your name, complete address, date of birth, and email address and click on the ”Submit” button. When your entry is received and recorded by the Sweepstakes computer you will receive one entry into the Sweepstakes for that Weekly Drawing and for the Grand Prize Drawing. Limit of one (1) entry per person, household or email address per Weekly Entry Period regardless of the method of entry. Maximum of 50 entries for the entire Sweepstakes Period. Any attempt by any participant to obtain more than one (1) entry per person, household or email address per Weekly Entry Period by using multiple/different email addresses, identities or any other methods will void that participant's entries and that participant will be disqualified from participation in the Sweepstakes. Entries must be received and recorded by 11:59:59 p.m. ET on Wednesday, March 31, 2010. You may also enter the Sweepstakes at the Sweepstakes Entry Areas at selected Events during the Sweepstakes Period (full list of events at mastertheshift.com) for the Weekly Drawing (corresponding to date of Event only) and the Grand Prize Drawing. Limit of one (1) entry per person, household or email address per event.
4. Drawings: There will be one weekly drawing for each week of the Sweepstakes Period from all eligible entries received prior to the close of that week’s end date. Entries not selected in a weekly drawing will not be retained for subsequent weekly drawings but will be retained for a random drawing held on/about 4/19/10 from all eligible entries received to select the winner of the Grand Prize. If for any reason a Weekly Entry Period consists of less than (7) days (with the exception of Weekly Entry Period #50), Sponsor at its sole discretion reserves the right to move entries from such week to a subsequent week and award two prizes in the subsequent week drawing. All drawings will be conducted by Alcone Marketing Group, an independent judging organization.
5. Notification: The potential Prize winners will each be notified by express mail, and will be required to complete, sign and return within a specified time an Affidavit or Declaration of Eligibility, a Liability Release, and where lawful, a Publicity Release and to provide additional documents as required by Sponsor. If Affidavits or Declarations/Releases and/or additional documents and releases are not received by the date stated on the notification, or if any notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, the potential winner will be disqualified and an alternate may be selected at the discretion of the Sponsor and Sweepstakes Administrator.
6. Prizes/Approximate Retail Values (ARV)/Odds: 50) Gear Prizes: Sporting or other Gear package to be awarded in the form of a gift card (determined by Sponsor). ARV: $500 each. (1) Grand Prize: A 2010 Nissan Altima SE with CVT, Premium, Technology and Sport Packages. (ARV: not to exceed $34,000). Total Value of Prize Structure is $59,000. Limit of one weekly prize per person. Odds of winning a prize depend on the number of eligible entries received for each drawing.
7. Prize Restrictions: No prize substitution, cash equivalent or transfer permitted except at sole discretion of Sponsor, who reserves the right to substitute all or part of a prize with one of comparable or greater value. Additional Grand Prize vehicle upgrades and options are at sole expense of the winner. Grand Prize Winner will be required to show current proof of insurance and valid driver’s license at time of prize acceptance and pick–up. Registration, title, licensing fees, taxes, insurance and other costs not specified associated with the vehicle, are solely the responsibility of the winner. Vehicle will be delivered at a dealership selected by Sponsor near winner’s residence. Grand Prize Winner must pick up vehicle within 45 days of notification that vehicle is available, or prize may be forfeited, and an alternate winner selected. Grand Prize Winner does not have choice of vehicle color and actual prize vehicle may differ from that shown in advertisements. Taxes and expenses not stated related to acceptance and use of a prize are solely the responsibility of the Prize winner. An IRS Form 1099 for the fair market value of a prize will be filed and a copy provided to the Grand Prize winner. Any difference between the approximate retail value and actual value of a prize will not be awarded.
8. General Conditions: By participating, Participants agree (a) to these Official Rules and the decisions of the Sponsor and judges, which decisions shall be final; (b) that Rodale Inc., Nissan North America, Inc., Alcone Marketing Group, Nissan dealers, TBWA\CHIAT\DAY, OMD Corporation, their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, entities involved in the design and implementation of the sweepstakes and their respective officers, directors, employees, representatives and agents (collectively “Releasees”) are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, or use of the prize or participation in this Sweepstakes (c) except where legally prohibited, winner grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval; and (d) that no representation or warranty, written or oral, express or implied, in law or in fact is made for any prize except by Sponsor in the limited written warranty provided with the Grand Prize vehicle.
9. Liability Limitations: Releasees are not responsible for lost, late, misdirected, incomplete, or non-delivered entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Releasees are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures, human error or other cause or causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or integrity of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel or terminate the Sweepstakes, and select the winner(s) from entries legitimately received prior to action taken or as otherwise deemed fair and appropriate by Sponsor; and notice thereof will be posted on the web site. Releasees are not responsible for any incorrect or inaccurate information, however caused. In case of dispute, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant in the Sweepstakes.

11. Dispute Resolution/Arbitration/Choice of Law: Except where prohibited, entrants (and each entrant's parent/legal guardian if entrant is a minor) agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York, without regard for the conflicts of law doctrine of that State or any other jurisdiction, and all proceedings shall take place in the County of New York, State of New York.
