Nissan "Master the Shift" Sweepstakes

1. Eligibility:The Nissan 2008 "Master the Shift" Sweepstakes ("Sweepstakes") is offered in and open only to legal residents of the United States and District of Columbia ("U.S.") age 18 and older who have a valid driver's license. Employees, officers, and directors of Rodale Inc.("Sponsor"), Nissan North America, Inc., Alcone Marketing Group, Nissan dealers, and each of their respective parents, affiliates and subsidiaries, advertising, promotion and fulfillment agencies, entities involved in the design and implementation of the sweepstakes, and the immediate family members (spouse, parents, siblings and children and their spouses and in-laws) and persons living in the same household of such individuals are not eligible. Void where prohibited.

2. Sweepstakes Period:Sweepstakes begins on May 28, 2008 at 12:00:01 a.m. Eastern Time (ET) and ends on December 31, 2008 at 11:59:59 p.m. (ET). A week begins on Monday at 12:00:01 a.m. (ET) and ends the following Sunday at 11:59:59 p.m. (ET), except for the first week which begins on Wednesday, May 28, 2008 at 12:00:01 a.m. (ET) and ends on the following Sunday, June 1, 2008 at 11:59:59 p.m. (ET) and the last week which begins on Monday, December 22, 2008 at 12:00:01 a.m. (ET) and ends on Wednesday, December 31, 2008 at 11:59:59 p.m. (ET). In addition, Weeks 17 - 21 will begin on 9/15/08 at 12:00:01 a.m. (ET) and end on 10/19/08 at 11:59:59 p.m. (ET) with (4) experience packages being awarded for that period. The Sweepstakes computer is the official time keeping device for the Sweepstakes.

3. To Participate: Access http://mastertheshift.com ("web site") and click on the icon, banner or text link to be taken to the Sweepstakes registration page. On that page provide the required information, specifically your name, complete address, date of birth, and email address and click on the "Submit" button. When your entry is received and recorded by the Sweepstakes computer you will receive one entry into the Sweepstakes for that Weekly Drawing and for the Grand Prize Drawing. Limit of one (1) entry per person, household or email address per Weekly Entry Period. Maximum of 31 entries for the entire Sweepstakes Period. Any attempt by any participant to obtain more than one (1) entry per person, household or email address per Weekly Entry Period by using multiple/different email addresses, identities or any other methods will void that participant's entries and that participant will be disqualified. Entries must be received and recorded by 11:59:59 p.m. ET on Wednesday, December 31, 2008.You may also enter the Master the Shift Sweepstakes at the Sweepstakes Entry Areas at selected Events (full list of events at mastertheshift.com) for the Weekly Drawing (corresponding to date of Event only) and the Grand Prize Drawing via computer at mastertheshift.com or via completion of a paper entry form, including your name, complete address, date of birth, and email address and submit in the entry box, at selected events during the Sweepstakes Period. Limit of one (1) entry per person, household or email address per event.

4. Drawings:There will be one weekly drawing for each week of the Sweepstakes Period from all eligible entries received prior to the close of that week's end date. Entries not selected in a weekly drawing will not be retained for subsequent weekly drawings but will be retained for a random drawing held on/about 1/16/09 from all eligible entries received to select the winner of the Grand Prize. All drawings will be conducted by Alcone Marketing Group, an independent judging organization.

5. Notification: The potential Prize winners will each be notified by express mail, and will be required to complete, sign and return within a specified time an Affidavit or Declaration of Eligibility, a Liability Release, and where lawful, a Publicity Release and may be required to provide additional documents as required by Sponsor. If a winner is not of the age of majority in his/her state or jurisdiction of residence ("minor"), prize may be awarded in name of, or to, winner's parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of winner and himself/herself, or prize may be forfeited and awarded to an alternate. If Affidavits or Declarations/Releases and/or additional documents and releases are not received by the date stated on the notification, or if any notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, the potential winner will be disqualified and an alternate may be selected at the discretion of the Sponsor and Sweepstakes Administrator. If an Experience Prize winner is a minor, winner must be accompanied by his/her parent/legal guardian as guest.

7. Prize Restrictions: No prize substitution, cash equivalent or transfer permitted except at sole discretion of Sponsor, who reserves the right to substitute all or part of a prize with one of comparable or greater value. Additional upgrades and options are at the sole expense of the winner. Grand Prize Winner will be required to show current proof of insurance and valid driver's license at time of prize acceptance and pick-up. Registration, title, licensing fees, taxes, insurance and other costs not specified associated with the vehicle, are solely the responsibility of the winner. Vehicle will be delivered at a dealership selected by Sponsor near winner's residence. Grand Prize Winner must pick up vehicle within 45 days of notification that vehicle is available, or prize may be forfeited, and an alternate winner selected. Grand Prize Winner does not have choice of vehicle color and actual prize vehicle may differ from that shown in advertisements. Taxes and expenses not stated related to acceptance and use of a prize are solely the responsibility of the Prize winner. If an Experience Prize winner is a minor, winner must be accompanied by his/her parent/legal guardian as guest. Winner and guest must comply with all security requirements. Trips may require different levels and types of physical activity, prior to participation a physical evaluation, health care professional examination/certification, various forms and releases (other than those required by Sponsor, as set forth below) may be required by the provider of the Trip. Determination whether winner (and guest) can participate in a specific Trip may be subject to the determination of the provider of the Trip. Trip must be completed on dates approved by Sponsor and within one year from the date prize is awarded. Participation in any Trip is subject to availability, change, restrictions, and any black-out periods which may apply. Travel guests of Experience Prize winners must execute a Liability Release and, where legal, Publicity Release within a specified time prior to issuance of travel documents. Once travel documents are issued, neither travel arrangements nor guest may be changed without the approval of Sponsor (which may be withheld for any reason whatsoever). Winner and guest must travel on same itinerary. Actual value of Experience Prize will vary depending upon destination and departure location. An IRS Form 1099 for the fair market value of a prize will be filed and a copy provided to the Grand Prize and Experience Prize winners. Any difference between the stated and actual value of a prize will not be awarded. Odds of winning depend on the number of eligible entries received for each drawing. Each prize winner agrees that Sponsor and Nissan North America, Inc. has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness, except the Grand Prize vehicle does include Nissan's standard vehicle limited warranty as set forth in the vehicle's Owner's Guide.

8. General Conditions: By participating, Participants (and participant's parent/legal guardian, if participant is a minor) agree (a) to these Official Rules and the decisions of the Sponsor and judges, which decisions shall be final; (b) that Rodale Inc., Nissan North America, Inc., Alcone Marketing Group, Nissan dealers, their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, entities involved in the design and implementation of the sweepstakes and their respective officers, directors, employees, representatives and agents (collectively "Releasees") are released, will have no liability whatsoever for, and shall be held harmless by participants (and a participant's parent/legal guardian, if participant is a minor) against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, or use of the prize or participation in this Sweepstakes (c) except where legally prohibited, winner (and winner's parent/legal guardian, if winner is minor) grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval; and (d) that no representation or warranty, written or oral, express or implied, in law or in fact is made for any prize except by Sponsor in the limited written warranty provided with the Grand Prize vehicle.

9. Liability Limitations: Releasees are not responsible for lost, late, misdirected, incomplete, or non-delivered entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Releasees are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. Should any portion of the Sweepstakes be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to cancel or terminate the Sweepstakes, and select the winner(s) from entries legitimately received prior to action taken or as otherwise deemed fair and appropriate by Sponsor; and notice thereof will be posted on the web site. Dispute Resolution/Arbitration/Choice of Law: Except where prohibited, entrants (and each entrant's parent/legal guardian if entrant is a minor) agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
